Medical Exceptions to Vehicle Window Tinting Laws

Most states regulate the amount of tinting allowed for your vehicle. Usually the standards are based on visibility from the outside of the vehicle to the interior. Most states require more visibility through the windshield and the driver’s window, but the rules are often more lenient for the rear windows.

Many customers these days are concerned with the passage of ultraviolet rays through the windows to the occupants inside, and those rays can be deflected without even shading the windows. However, many prefer the look and increased privacy of darker tinted windows, and for those customers it is important to know your state’s laws (or to choose an installer who is experienced enough to be acquainted with the laws).

In many states it is possible to receive an exemption to window tinting laws based on medical necessity. Medical conditions like melanoma, dermatomyositis, albinism, photosensitivity, lupus and some allergies make the sun’s rays more harmful than usual. Florida law dictates that you have a simple one page form filled out by your physician describing your condition and the reason for window tinting. You then simply fill out the vehicle information, attach a copy of your driver’s license, and mail it to the State of Florida Division of Motorist Services. Once filed their is no expiration date, and it is also non-transferable. So if you get a new car you will have to submit a new form for the new vehicle. This process enters your vehicle into the data base so if you were to be pulled over by law enforcement they would know you were medical exempt on window tinting the moment they run your license plate.

The risk of skin cancer is a common reason for car owners to seek window tinting, but without an actual diagnosis, a concern for prevention will not be enough reason to circumvent your state’s laws. However, it is easy to block most of the sun’s harmful rays without violating the law. In such cases it is safer to use a professional installer rather than a do-it-yourself kit. Professionals are familiar with the laws of their states, and they are also familiar with the requirements for documenting medical exceptions.
